The Ugandan People's Defence Forces serving in Somalia have called on the government to make special arrangements for them to go back to Uganda to attend to their sexual needs.



In response, Ugandan army spokesman, Felix Kulayigye said the army will not grant the request, but rather they should persevere like the USA Navy troops who spend years in service, thousands of miles away from their country.

"The soldiers asking for sex leave should be patient. After all they stay in Somalia for only 9 months before they return to Uganda and another group is sent to replace them," said Kulayigye.

"Nine months is not a very long period for one to do without sex. USA navy troops take years while away on missions but they do their work without complaining about lack of sex."

The soldiers made their request when five Ugandan Members of Parliament recently visited the peace keepers in Mogadishu, a first such visit by the country's legislators since troops were deployed in 2007.

A former Ugandan soldier, who served under AMISOM in Somalia, speaking anonymously, said it was "difficult to get women in Somalia beacuse of their culture and strictness. One of (my colleagues) impregnated a woman but was punished in Uganda".

Milton Muwuma, who led the delegation of legislators, said the soldiers were happy to see them and talked freely with them about the problems they encounter including lack of sex.

Uganda has about 7 000 troops in Somali, while Burundi, the only other African country with troops in the Horn of Africa nation, has about 6000 soldiers serving under AU force AMISOM.

This week's acquittal of soldiers who allegedly gang-raped and incapacitated a young girl in Moroto has copiously added pain to the terrible effect that Ms Teddy Nakiru is carrying after a rape that took place on New Year's Eve. There was medical evidence that Ms Nakiru was raped and one of the defendants, Pte. James Manana, admitted to have had a sexual encounter with the victim, but claimed she was his girlfriend. The army court, sitting in Moroto District, however, ruled on Tuesday that, "The state had not proved its case beyond reasonable doubt as required by law and subsequently found Pte. Manana not guilty of the offence of rape."

Twelve soldiers

Reports alleged that about 12 soldiers gang-raped Ms Nakiru, 24. It was alleged that the rape happened after Pte. Manana bought the woman sachets of waragi and reportedly took her to a bush and forced her into sex. However, the victim tells a different story. Ms Nakiru, according to her narrative, had gone to attend a church function at Tapac Trading Centre organised to usher in the new year but little did she know that misfortune was awaiting her.

The night

On that fateful night, at around 11pm, Ms Nakiru decided to leave the function after soldiers, who were sent to guard the congregation, ordered everybody to leave, saying it was late. "As I was walking alone on my way back home, I met a group of soldiers; they first asked for my name but I kept quiet and continued walking, then one of them grabbed my hand while another shut my mouth and they stripped me naked. I fell down, three of them came over me and two others spread apart my legs. They started to rape me," Ms Nakiru narrates, adding that she recalls only waking up in the hospital in terrible pain.

Dumped under bridge

Mr Mathew Lochap, one of those who found her and rushed her to the hospital said: "We believe that these people after gang-raping dumped her under the bridge [because] that's where we found her lying helpless." Mr Lochap narrates that by the time they found Ms Nakiru, "she was bleeding profusely from her private parts, her stomach was swollen and her clothes drenched in blood." While at Moroto Hospital, her condition worsened and she was referred to Mulago Hospital for further medical attention. X-ray examination indicated that her backbone was broken. The doctors operated her and two metals were fitted in her back.

Dr Andrew Shukura, the acting medical Superintendent of Moroto Hospital, said Ms Nakiru was referred to Mulago Hospital for medical expert attention since her private parts were severely damaged. After a few weeks at Mulago, she was taken back to Moroto army health centre, by the army, for the hearing of her case, which started on February 11.

Hearing of the case

During the first hearing of the case at the army court martial in Tapac, Ms Nakiru was bombarded with questions by the UPDF lawyer. She failed to answer the questions and instead collapsed. The case was adjourned. Nobody could defend her.

The UPDF Third Division Spokesperson, Capt. Deo Akiki said the 12 soldiers alleged to have gang-raped Ms Nakiru were the soldiers on guard posts on the fateful night and in order to have thorough investigations all of them were arrested but later three were identified as the ones who had a case to answer. However, Cpl. Kakuru Machat and Cpl. Okulo Oyo Naleo were said to have no case to answer; only Pte. Manana was said to have.

The army instituted investigations headed by the army counter intelligence department into the alleged rape case to bring the culprits to book. This was after Daily Monitor carried a story about the incident in February. The then Third Division Commander Bridg. Patrick Kankiriho, suspended three senior officers for not reporting the case. This week's acquittal of Pte. Manana, of rape but dismissal from the army for indiscipline, has angered Ms Nakiru's family, who said it cannot undo the pain their daughter is going through. She uses a wheelchair to aid her movement but still her mother must be there to push her around. She can't sit or stand by herself.

The parents react

"No problem, God knows because we couldn't afford a lawyer," said Mr Icumar Lokol, Ms Nakiru's uncle. Adding that the court martial ruling was meant to absolve "their soldiers." Her mother Ms Veronica Nakiru said the condition of her daughter is worsening and a mixture of blood and pus oozes from where the metal was inserted on her back. "My daughter is now going to die as if I had quarreled with the army," said Ms Nakiru as tears freely streamed down her cheek.

The army has, however, promised to take Ms Nakiru back to Mulago Hospital for medical attention. But the date is unknown. Ms Nakiru's mother said the officers told her there is no fuel and will transport the girl to the hospital as soon as they get it [fuel].

Upon courts evaluation of both the prosecution evidence and defence evidence they found that the state had not proved its case beyond reasonable doubt as required by the law and subsequently found A1 Pte. JamesManana not guilty of the offence of rape but rather guilty of the offence of conduct prejudicial to good order and discipline of the defence forces contrary to section 178 of the UPDF act No 07/2005 for he was deployed on duty but he opted to abandon his duty post and he went to satisfy his social needs of which his social needs resulted into a grievous body harm of one Teddy Nakiru. He was subsequently sentenced to a dismissal with disgrace from the Armed Forces. This sentence was to deter all officers and men of UPDF to desist from going to their own escapades other than executing their lawful duties.

The convicts were informed of their right of Appeal to the General Court Martial within 14 days if they were not satisfied with the decision of the trial court. Judgement was delivered on September 27, 2011 at Tapac Trading Centre in Moroto District by the 3rd Division Court Martial Lt. Col Patrick Mwesigye.
