hi there...my friend we probably disagreed on many things but one and that's Somalia need to be back on it's feet....for that to happen i believe we need to lay down some ground rules and educate our people about it....a constitution must be drafted....in my opinion it must be based on fedaralism....we need to balance power and the same time giving the people a jurisdiction over own areas.....here is my version of what should somalia should be?
A Federal Republic
Legislative Branch
Judiciary Branch
An executive Branch

1.Legislative Branch
Two houses:
A.Upper House
B Lower House
the officails or the representatives should be elected from their respective districts...the Upper house should include a fixed number of individuals from each state...meaning if somaliland has two representive in the upper so should other states...and this is in fairnes to all people
The lower House should include representatives from the districts in each state...so that every districts in the country has representive in the parliament.

2.Judicairy Branch. Appointed judges approved by the president and the parliament...Federal courts should operate in all states and should have the power to over-turn any decisions made by state goverments or courts...The federal supreme court should be the highest court and the one that can have the last say
3. Executive Branch....there should be a president..one sole legitamate leader elected by the parliament for full two terms maximum...he should be one running the country and the commander in cheif of the armed forces
What could a federal goverment do?
a federal should have the means to taxe,pass legislations, over-ride state laws...the sole representive of somalia on the international stage...control commerce with foriegn countries and within somalia it's self , enforce the rule of law....basically the federal gov would be far more powerfull than local goverments..it is a reflection of the country as whole....state goverments should be left with things like education but the federal gov should have the power to intervene when it feels the states are not doing good job....state should be rewarded according to their merits.

i was just giving yu an example of how things could be done.......i don't think there is anything wrong if someone wants jurisdiction over his land and his men/women represent them at federal level....1Anon if yu have better form of governance....plz share it

why the federalism is the only solution?
Only few countries in the world have the federalism and these are largest countries in the world.like U.S.A. and Russia.
A federalism will not work in Somali because
1) Somali is a small country
2) The tribe conflict still will exist. Because tribesmen do not have limit. Even if people who belong to same tribe built their own state still the tribes will fight for the power in the new states. It is already happening puntland and Somaliland.
3) It will create Poor region
4) With lot of power to states governors the existents of Somalia as a nation will be hurt.
I have slightly different solution. Instead states we can keep our 18 provinces and we can create one more parliament for governors. Most of important thing is to decentralize the power and every province will have it is own local government, every district will have it is own government and central government will take care the army(not the police) and in case to give more money to poor regions, to prevent people to move more wealth provinces.

While the form of government that should be adopted by Somalia can draw heavily on European and American sources, it should nonetheless be distinctly Somalian as there is no such thing as a "one size fits all" type of government. Somali-Yankee, you've got some good ideas here-I'm currently working on a paper dealing with what sort of governments will prosper in Somalia's distinctly clan based politics. Anyway keep up the good work bro.

You did not mention which countries who have Federal system. Yes Ethiopia does by the name, First it is not the one you want copy for, secondly Ethiopia still is larger country than Somalia with many ethnic people. There are many systems and I do not see the need to copy a system from somewhere else. Like U.S.A. or Canada Federal system will not work in Somalia. At least 40% of U.S.A. population are from minority groups and they have very few people in both houses. Somalia need a unique system which makes happy majority of the Somalis and we have to learn the past experience

Your question deals with political development, and I think its very important question. However, what you are advancing is a weak and idealistic argument which has nothing to do with the political reality of a primitive country like Somalia. Three questions: who is going to do it? why it has not been done before in Africa? Will anything ever gets done in Sub-Saharan Africa, including Somalia? Is 40 years of "independent" enough to critique Somalia, and tackle its problems rationally?

LOVE YOUR FIRE, BUT HATE YOUR PHOTOCOPYING CAPABILITIES.

All you did was copy the American system and say it was good for somalia, why because it works well here, because it allows you to get to your school and back without being shot.. Given time you will grow up and go from IDEALISTIC to REALISTIC. I though about the federalist idealogy, you will find the answers why on your own...

Sirrus...it seems you are on my tail my friend.... i know where my ideas are from....yeah mostly from the US constitution...i was merely trying to tell somalis when we need some political platform that would work for Somalia...it doesn't have to be a replica of something that's already there...it is saddening to see the so-called goverment not doing anything to create some sort political conciousness among the somalis and not inviting the opposing parties.
Durgal it hasn't been done before it doesn't we can't do....we are at important juncture in our history and we have unique oppurtunity to capatilize on what we got...we can lay ground rules for better somalia.

People if you want to change something you have to be realistic about it, or else, the only thing you are going to do is just " bacaad gurmo ku qabo". I have studied somalia's history, political development and It seems that we were nominally independent, like most of Sub-saharan Africa. This does not mean I am shifting the blame from Somalis to colonial powers, however it would be tremendous mistake to view Somalia's problems as the work of Somalis alone. Somalia never adjusted The current Westren system of Nation-state and as consequence it had to suffer. Whoever is going to lead somalia out of this mess must understand two things: the uniqueness of the Somali personality, and the structure of modern nation state. Particular emphasis must be given the compatibility of the two, if they fit at all. It is in this context that I posed the three questions: who will do it, why it has not been done before? And does anything get done in Africa? Somali Yankee you are perceptive man, however, there are many things you don't know, and that is normal people acquire new information constantly and as result they change their veiws. I completely understand your point when you said " we have unique chance for Federalism", however, It is my veiw that present system in Somalia whether it is federalism or centralism cannot contribute a healthy and dynamic structure. In other words the system is beyond reform, and it must be overthrown and destroyed. There are inherent constraint within the system which will not allow anyone either to change or reform. Some of these constraints are local, however, as most of our constraints have emanated traditionally from bourgoies countries with the intension of proving their domination to the black people, almost all of the contraints to new system will most likely remain. Therefore we need to overthrow the system and replace it with a system which represents the will of our people.

I will post this article " The future of Somalia" tomorrow. In it I will expose these contraints in detail by showing not only how the past system couldn't correct itself but also how the present is likely to fail. Thus if Somalia wants to survive we need to take a different path.
