Muslim Airport Employee Suspended For Refusing To Wear Knee-Length Skirt

A security guard at Toronto's Pearson Airport was ordered off the job for wearing a skirt that's too long.

Halima Muse, a practicing Muslim, was laid off without pay by the Canadian Air Transport Security Authority until she agrees to wear a standard uniform that includes either slacks or a skirt that falls at the knee.

Not willing to oblige by the rules, she took matters into her own hands and filed a complaint to the Canadian Human Rights Commission saying she was the target of religious discrimination, since Islam instructs that she dress modestly.

Muse, 33, claims that she's never had any problems with her employer in the five years that she's worked there, until now. She told media that her decision to sport the longer skirt was not a matter of personal style, it was about dignity.

In a statement she made to the Commission, Muse said she never liked the uniform pants that she used to wear because they showed the shape of her body. So she asked the person in charge of work attire for a skirt that's longer than the standard one, but was told it didn't exist. So she went out and bought material matching in colour and made her own skirt that reached her ankle.

For six months, nobody said anything to her about the garment until a manager told her she had to conform to regulations. She was suspended for one day on Aug. 11, then for three days on Aug. 15 followed by a subsequent five-day suspension and then was sent home indefinitely on Aug. 29.

A single mother from Somalia with a teenage son, Muse has been out of a job for the last three months. In that time, she's racked up debt on her credit card and has been borrowing money from relatives, according to a media report.

She said the federal employment insurance agency has rejected her application because she's not officially unemployed. She's allowed to go back to work as long as she conforms to regulations that she considers to be a violation of her religious rights.

She should get a good lawyer and suit them,wallahi. This is unacceptable and utterly wrong in many ways. There was a lady here in the US a year ago I think who won a similar case against her employer.

I love my job, not only are we allowed to dress in whatever but we are also provide a quite room for nursing or prayers.

Plus it cost alot of money to take a major airlines to court, so justice is only for the rich.

Good thing she didn't submit and was changed into the short skirt in order to keep her job.

The airline company should be sued, maybe she can find other Muslim women who went through the same thing and all of them can make a claim against the company. Numbers can help.

I haven't seen the outfit, but if it's a uniform it must meet community standards for modesty. Was she or was she not aware there was a uniform that went with the job when she applied? Are hijab or burka next?

I am not suggesting she change her standard of dress. I just think that if it was an issue when she took the job it should have been addressed then. I don't think the courts are going to consider that she has a right now to refuse to wear the uniform. Same goes for men.

In the US, the Amish are pacifists and do not serve in the military or in any armed capacity. And there are certain other conscientious objector categories, where religion or ethics prevent individuals from serving. It seems equally inappropriate to me for those who cannot wear the uniform to serve in the uniformed services.

I will be very interested to see what the Canadian courts do with this.

She wore it for six months, after which she was suspended on three occassions and given the opportunity to return in regulation dress. She chose not to.

At least here in canada, the law protects you against religous discrimination...It seems like the lady has a case, she can dispute it in court. Could you say the same priveledge, and human right is available to a person in several Muslim countries?

I read that, but her concern is that slacks highlight her figure (and if she's futoweyne, I understand her concerns ). Therefore, my suggestion was a bit of a compromise for both parties.

Grant, I’m not sure what it’s like in the States but here in Canada, we have something we call “reasonable accommodation”. An employer is expected to accommodate the employee as long as there is no “undue hardship” on the employer. More often than not, “undue hardship” in the business world is measured in terms of money and a corporation’s ability to absorb this hardship. The Onus is on the employer to prove why a few inches added to dress caused them “undue hardship”. We’ve seen this debate over and over again in Canada and fortunately the bigots always lose out because they lack reason. I wouldn’t hold my breath if I were you Grant we have ample precedent on these sorts of issues in Canada, the RCMP and Sikh turbans is a classic example of this. Allow me to inform you since you’ve asked Muslim woman are allowed to wear the Hijab while they work.

FAH1223, It’s not about “why now?” reason is irrelevant to one who appears to hate your kind. Fortunately most Canadians are embarrassed that in this day and age that woman can got fired over the length of her skirt. It is truly absurd if you ask me and it humors me to listen to all their lofty reasons as to why they cannot or should not accommodate Ms Halima.

Waranle, something tells me that Ms Halima will have the last laugh and a few people from upper management will lose their jobs over this unwise decision.

Mike you gotto to be kidding bro! Wear pants and knee length skirt over the pants. How is that any better, she still won’t be complying with either regulation uniforms, not to mention she’ll look like a clown and her "concern" wont get any smaller, if you catch my drift.
