OPEN LETTER FROM HAWIYE COMMUNITY

The Transitional Federal Government was an outcome of two and half years reconciliation conference held in Kenya, participated by various stakeholder of Somalia Conflict. Somalia conflict has been lacking for a successful reconciliation process that resolves major issues include the powering sharing formula, the political and leadership system that suits the Somali culture and people. In conclusion, October 2005, the basics of political destiny of Somalia has been agreed by laying down the foundations of Transitional Federal Government( TFG) with three strong pillars of 4.5 Power Sharing Formula, Transitional Charter and Federal Administrations. On the basis of these pillars parliament was established, the President was elected, and cabinet was nominated.
The initial mandate of transitional government were to cease hostilities and complete the reconciliation process, seek people’s legitimacy and mandate, put together the basic functioning administration in the country that leads into the establishment of federal regional administrations and finally within the political term of TFG, lead the nation into national elections after a successful referendum for the national constitution.
The Current Transitional Federal Government has lost the vision, direction and trust that have been mandated for which makes the TFG to be illegal and unconstitutional due to the following:

The TFG has violated the transitional charter and the spirit of the reconciliatory government after entirely failed to accomplish its mandate. It’s a clear evident that the TFG disregarded the charter and acted as a unilateral power, and breached all principles that have been agreed in Mbagathi, Kenya. The consequence remains the TFG to categorically loose its legitimacy and power base in the country.

The powering sharing formula have been abused or ignored and major principle stake holders in the government mainly the Mbagathi signatory include Mohamed Qanyare, Muse Sudi, Botan Esse, Omar Finish, Ahmed Omar Jess, Abdulasis Sh. Yusuf, Mohamud Sifir and Barre Hirale have condemned the government of not observing or respecting the principles that have been agreed. These members represent wide constituencies in the country and have been either marginalized or excluded in the government. Bearing in mind that these leaders have strong support in the their communities and their exclusion will consequently make the TFG to be weaker and loose the support of potential communities in the country. Most of these constituencies have been expressing concerns on the situation and astonished by whether the illegal presence of Ethiopian forces will bring a legitimacy and support to the government, rather then searching for a nationwide backing and patronage of the Somali people. It is a common knowledge that some of these leaders significantly contributed to exposure of the risk of Al-qaida in the country and supported TFG to demise the risk and encouraged the International and regional efforts of minimizing the risk of proliferation of Al-qaida cells in Somalia. The American government have betrayed its alliances in the country after Ethiopian forces have minimized the risk of Al-qaida in the country.

The insurgency and resistance against Ethiopian and TFG forces will continue as most of the Somali people questioning the neutrality of Ethiopian forces or perceiving as an occupying force. The Somali people are concerned about the deep interference engaged by both Ethiopian government and their military commanders in the internal affairs of Somalia. Every body is aware the illegal presence of Ethiopian forces in the country but their deep involvement in the clan politics and their naked support of some clans and their deep attachment on the government administration particularly illegal nomination of regional administrations, associateship with particular politicians and business people in looting the treasure of the country and getting corruptions, makes the Ethiopian forces to be considered as an occupying forces and disapproved their claim of being a good neighbors that come to help the Somali people to overcome its problems .
TFG has failed to control the behavior and the practices of the occupying Ethiopian forces since there were no clear terms of engagement between the two governments and also American Government who funded and supported the invasion of Somalia has given the Ethiopian forces a green light of looting, killing, displacing, raping and finally sanctioned war crimes and genocides against the Somali people.

The TFG has ignored the catastrophy of Mogadishu and Southern Somalia where more then one million people are displaced and denied any humanitarian assistance while another thousands have been either killed or died for starvation after Ethiopian and American forces used heavy artillery shelling and Air-strikes in the country. Southern regions are the worse affected area and very little information is available and Air-strikes are extended now to remote areas of the Country. In addition to that Somali Government frustrated the international efforts of bringing aid to stricken people after imposing a lot of administrative obstacles.
When the military confrontations have subsidized a lot of civilian and innocent people were arrested without any trial under the guise of war on terror. Thousands are in the custody of TFG and all rights of justices have been denied.

The TFG has failed to organize any meaningful reconciliation conference that enables to bring a sustainable peace in the country. The so-called reconciliation conference called by TFG have no clear objective, programe , process, and participation criteria. That makes the conference trivial and superficial. It is unfortune that the long-waited national conference that to be held inside the country and expected to be the only legitimate conference that brings a national social healing and laying-down the foundations of solid democratic nation for Somalia to end up in confusion and disarray.
Today the Somali people again are disappointed and disturbed by involvement of Ethiopians in the process of the conference. It is our knowledge and trust that Ethiopians can not and will not be the trusted broker of Somali reconciliation and cannot promote the type of nation and political system that Somalis are in search for which is a democratic nation. We all aware that democratic nations breed democracy and Ethiopian needs democracy more then Somalia.
Based on that it is importance that the reconciliation conference to proceed with out any foreign interference and Somalis to bring a home grown solution of their problem based on their culture and interest.

6- The TFG has failed to setup an accountable system and reliable public institutions that enables the government to become accountable to its people. But rather started promoting the corruptions, misappropriation of public resources and lack of transparency. In addition to that it has introduced an administrative system and policies that has no harmony in the whole country or at least the regions that support the TFG. These made the TFG to be considered as partial and not inclusive and the adopted policies seen as subjugative and designed for specific community particularly the Hawiye.

Therefore, we as Hawiye intellectuals, traditional leaders, political leaders, business community, women groups, youth and community at large declare that we have lost the confidence on the TFG and call for immediate withdrawal of oppressive Ethiopian forces with the replacement of UN forces and instantaneously to be dissolved the TFG government and call national election under the auspices of the UN and international peacekeeping forces. We also call for, UN, European Union, Arab League, Islamic Conference, IGAD and rest of International Community to support for the national elections. We also call for United States of America to stop the support of the invasion of Somalia and dialogue with the Somali People.
