The Qawaacid of Ahlu sunna wal jamaaca is to judge what is apparent and leave whats hidden for allah to judge. This is the methodology of Cumar ibn al khadaab when he told the companions after the passing of the prophet who received revelations clarifying the munaafiq from the mu'min. Cumar (ra) explained Since the prophet (saw) was gone, people will be judged by what they come by. If someone shows clear allegiance to those fighting the sahaaba such as the persiansa and romans, then he will judged by what is apparent, since his intentions could never be known.
This line of argument, that the accusers have to prove the other party is "intentionally"
doing kufr, is quite old, and it has been used before. FYI you can check this thread about the struggles of Sh. Usman dan fodio who, interestengly was a sufi from the qaadiriya order, but still waged jihad against those who were committing shirk and immoral islamic rulers. Some of the scholars defending the rulers he was fighting used the same argument that it was not the intention of those worshiping idols and graves to do so, and they were replied with that the intention of the perpetuators would be left to GOD, and us humans would judge the actions with which the accused party were guilty of.
