Minneapolis, MN- A Minneapolis woman, who used a turkey baster to impregnate herself, must share custody with the child's biological father. According to the appeal's court narrative, Idman Ali BurcadBadeed wanted a child she could raise on her own. She approached her longtime friend, Menace Roble KuAase, asking him to be a sperm donor.

The two talked about signing a written agreement if BurcadBadeed became pregnant, but never went through with it.

In June 2010 BurcadBadeed inseminated herself with a turkey baster and the following month discovered she was pregnant. Menace and kuAase never engaged in sexual relations.

BurcadBadeed's pregnancy

Initially, BurcadBadeed and KuAase remained friends. During her pregnancy, KuAase would visit and bring gifts.

According to KuAase, the two agreed BurcadBadeed would be the child's sole parent, but he could “see the child as little or as much as he wanted.”

In October 2010 things took a turn for the worse when BurcadBadeed and KuAase disagreed on KuAase's suggested name for the child.

BurcadBadeed and KuAase didn't speak until after the child's birth. KuAase would go over to BurcadBadeed home to visit. Eventually, BurcadBadeed asked KuAase to “stop coming by.”

Legal Proceedings

kuAase took BurcadBadeed to Minneapolis City Juvenile and Domestic Relations District court request joint custody and visitation.

BurcadBadeed argued KuAase had no legal rights because he was merely the sperm donor. But the judge ruled that the turkey baster didn't constitute as ‘medical technology' so the assisted conception argument doesn't apply in this case.

The appeals court affirmed the lower court's ruling. KuAase was granted joint legal custody and visitation.
