Somali Government, US Company Dispute Legality of Oil Deal

The Somali government and a U.S. company are locked in a dispute over the validity of an oil exploration agreement reached in February in Istanbul.

Abdirashid Mohamed Ahmed, Somalia's minister of petroleum and mineral resources, and Richard Anderson, chief executive officer of Coastline Exploration Ltd., signed the agreement. But in separate statements, Somali President Mohamed Abdullahi Mohamed, known as Farmaajo, and Prime Minister Mohamed Hussein Roble rejected the deal, declaring it "null and void."

Both leaders cited government decrees and directives banning all ministries and government agencies from signing agreements with foreign governments and organizations until ongoing parliamentary elections are finalized. The elections are expected to conclude next month with the election of a new president.

In addition, the government has instructed Attorney General Suleiman Mohamed Mohamud to investigate the contract and take appropriate legal measures.

The government's position is that the agreement is in contravention of a presidential decree dated August 7, 2021, and a Council of Ministers directive on December 6, 2018. The mandate of the current legislative and executive branches expired more than a year ago. The government said correct procedures have not been followed; therefore, the agreement is "null and void," according to a February 21 letter sent by the Foreign Affairs Ministry to Coastline Exploration and obtained by VOA.

Anderson disagrees with the letter and disputes the government's interpretation of the legality of the agreement.

"I won't go into the legal details of the analysis, but we believe quite firmly that our PSAs (production-sharing agreements) we signed are legally valid and that they're in full effect," he said in an interview.

VOA asked Anderson why the company ignored the Somali president's decree and a letter from a joint parliamentary committee on natural resources that instruct government agencies not to enter agreements during the election period.

"We did not ignore anything," Anderson said. "Before we signed the PSAs in February, we consulted with the ministry and with the SPA (Somali Petroleum Authority), and we were assured that both the president and PM were aware of the process and they were fine with the signing."

Nice try MBB got caught redheanded and the minster tried to blame farmaajo after he got caught. If one thing all all Somalis agree on is farmaajo isn’t money hungry, corrupt or a thief. MBB should come up with a believable story. The guy who refused 80m from saudis, kept 9.5 million for three years, paid soldiers, FMs, and the whole government on time baad leedahay he caught stealing couple millions. you yourself believe that’s not true deep inside and the minister and Baahane got caught redheanded. Anyways this oil deal is shady and is a way for Hutus to steal money after AAW 15cod and co come back from begging worldwide.

The hsm admin claims to make amendments to the agreement but doesn’t provide any details. Zero transparency. How much did they pocket for this?

The agreement is illegal with no signed agreements between fms and fgs on resources sharing. This pariah company is taking advantage of an incompetent government. Good luck to south Somalia, hsm will sell your resources the first bidder and the average person will not see a penny from it.

You know what the funny thing is? The relationship between the Somali people and the current information handlers of this government truly and sincerely remind me of a case study I once came across while taking a psychology class back in undergrad.

The subject: When manipulation is confronted by disinterest

A successful manipulation requires you to be "coerced." It is like a bottle of gasoline that wants to explode into fiery ball and engulf everything around it----but without someone striking a match, it is just a thick, dense, blob that is earthen in color.

Getting someone to strike the match, the manipulator has to "coerce" you to give up control of your reaction before you can be "manipulated."

The coercion is achieved by triggering you, shocking you, surprising you---which all is dependent on you first parting with your attention and interest.

The single, greatest obstacle to a manipulator is----disinterest, boredom.

Gasoline when lit has awesome, immense energy. Without the spark to bring that energy to light, it is just a thick, dense, bloob earthen in color.

The human expresses disinterest and boredom when he has seen the same thing before. We rarely care to read a book again or watch a move a second time for a very good reason.

When we have seen something before; we already know what to expect.

At what point will someone in the orbit of these communicatiom hands of HSM go up to them, one wonders, and be like "uhm, guys, you are talking to an empty audience.

Don't worry PL is not part of this agreement blame the Tuug Farmaajo. it will be endorsed by the parliament maybe next session and they will approve it!.

Do you seriously think this shady deal is good for the average person in Somalia ? It’s no different than selling Somali waters to Kenya. Anything to do with shared Somali resources should be done with the utmost of transparency. Even PL or SL is no different when it comes to this kind of corruption.

We truly have the worst leaders in the world.

This is good news for Somalia.
We desperately need these potential oil revenues.
Of course there will be corruption but the benefits far outweigh the risks.

Somalia has fabulous riches onshore and offshore.
Now is the time to begin to develop an oil/ gas industry.

Puntland has nothing to do with the southern blocs so should be ignored completely.

Totally agree with this. The benefits outweigh the drawbacks, as long as Somalis are involved it will be corrupt so no point crying about it. Also very weird puntland region residents seem to be against this when it doesn’t concern them, cajiib

Great news for Somalia, if hsm pulls this off his might stay another few terms. Ustaad do you which nations/companies are in the running to drill? I hope Eurasian companies are given preference since the west is economically collapsing
