This is not something to glout with when you understand the court threw out the MoU signed by Abdirahman Abdi Shakur. In conclusion we lost land not because of MoU signed by past administrations but the incompetency of Farmajo government

Like Bashi said, the entire reason Kenya had reason to claim there was a "dispute" to begin with is due to the MOU.
1. The Court did not "throw out" the MOU.
2. It recognized it as a valid document which "made" Somalia "agree" that there was a "dispute."
3. The Court then said because "both" sides "recognize" there was a "dispute," the Court then had "jurisdiction" to judge in the "dispute."
The Court then ruled in Somalia's favor with an adjusted reward.
Without the MOU, there would never be a legal dispute to begin with as Kenya had already confirmed in multiple treaties and laws that it limited its claims following the land border.
