i agree with you but this kind of punishment التعزيز was left for the judge to decide, this is one of the kind, sharia opened the door for ijtihaad for crimes that has no limit or crimes that horror the society. depends on time and society and the criminal`s situation. unfortunately, it depends on the judge`s judgement and his mental background. not all the mujtahideen agreed. just simply given green light to do what (he thinks, the judge or imaam )fits that particular crime/society and not necessary is right or wrong.
