Hey guys this looks like a good topic so i thought i might add my two cents. Smile

Muslim sis,

First of all I kindly ask you to acknowledge other people’s work especially when you copy and paste entire articles word for word! In this case it is even more important because the topic is one that is highly contested in Islamic discourse. As for the topic my opinion is that the holy quran (which I consider the primary and most important source of guidance for mankind) does not ask us to kill adulterers and fornicators. There are only two important suras in the Quran in regards to the topic that I have found are an-Nur 24:2 which most of you have quoted, although I have noticed the one online salafi Quran translation website has an extra sentence at the end about stoning people to death in brackets very doggy!

This is another sura that may help in clarifying the issue of stoning which was brought to my attention by a friend I was discussing the issue of slavery sometime ago is {an-Nisa' 4:25} which have quoted below and I have put the sentence in regards to stoning adulterers in bold. The argument is if the punishment is stoning how would you stone a bond woman to “half-death”?

{an-Nisa 4:25} And whoso is not able to afford to marry free, believing women, let them marry from the believing maids whom your right hands possess. Allah knoweth best (concerning) your faith. Ye (proceed) one from another; so wed them by permission of their folk, and give unto them their portions in kindness, they being honest, not debauched nor of loose conduct. [b]And if when they are honourably married they commit lewdness they shall ]incur the half of the punishment (prescribed) for free women (in that case). [/b]This is for him among you who feareth to commit sin. But to have patience would be better for you. Allah is Forgiving, Merciful.

The only explanation I have for the stoning to death is that it is it is one of those ideas from the bible that has remained with us even after the revelation of the holly Quran.

Here are the verses in the bible which mention stoning adulterers.

I cant believe the revisionism that is taking place here! Stone to death is unanimously agreed upon by all the sahaba and our great scholars from all 4 schools of thought! saying salafis or wahabis are the only people who condone stoning to death for an adulterer is a big lie to say the least! I challenge anyone to quote a sahab or one of the great four imams rejecting stoning to death for Adulterers.

Question :

Recently a certain Yusuf Ismail of Durban had written to the "Daily News" of April 9, 2002 under the heading "Adultress stoning is not Islamic law". The brother blatantly rejects stoning to death the adulterer and adulteress as a "way out" , referring to it as "this barbaric custom". There was further confusion in the role of stoning when letters to the editor from non-Muslims said the things like "Is he (Yusuf Ismail) sure stoningis not Islamic Law?" We the ordinary Muslims are rather confused - can the Jurists / Ulama please clarify the Islamic perspective?

Answer : Matters related to Shariah are proven primarily from the Qur’an, Hadith and Consensus of the Muslims. If any question still remains unanswered then we refer to the works of the Great Jurists of the past.

The matter under discussion i.e. adultery and the stoning of the adulterers is clearly established in the Holy Quran, Hadith and the consensus of the Sahabah (Radiallaahu Anhum) i.e. the Companions of the Holy Prophet (Sallallaahu Alayhi Wa Sallam).

Allah Ta’ala mentions in Verse 15 of Sura An-Nisaa,

"And those of your women who commit illegal intercourse, take the evidence of four witnesses from amongst you against them, and if they testify, confine them (i.e. women ) to the houses until death comes to them or Allah ordains for them a way out." This way was explained by Rasulullah (Sallallaahu Alayhi Wa Sallam) in clear unconditional terms.

Ubaada bin Saamit (Radiallaahu Anhu) says, "Rasulullah r used to become over-burdened when Wahi (revelation) used to descend upon him and his face used to become pale. One day revelation descended upon him r and he had the same experience. After the revelation he r said, "Take (this command of Allah) from me. Allah has ordained "a way out" for them (adultress). A person married in a valid Islamic contract would be lashed 100 times and then stoned to death. An unmarried person will be lashed 100 times and then expelled from the city for a year."(Ahkaamul Quran -Vol 2 Pg 107)

So, "way out" was not explained or interpreted by human logic, but was a revelation from Allah Ta’ala. Similar are the examples of salaat, zakaat and other obligations in Shariah. The pragmatic method of salaat and zakaat is not found in the Qur’an, nor is any human using his limited intellect permitted to interpret them.

Every Muslim understands and believes very firmly that the method and times for salaah as well as the details pertaining to zakaat that were taught by Rasulullah (Sallallaahu Alayhi Wa Sallam) is the divine way shown by Allah Ta’ala through revelation.

No Muslim in a sane state of mind can negate this.

In the very same way Allah Ta’ala has explained that He will ordain "a way out". This way was explained by Rasulullah (Sallallaahu Alayhi Wa Sallam) in clear unconditional terms

There are many other traditions of Rasulullah (Sallallaahu Alayhi Wa Sallam) in which the "stoning of adulterer and adulteress" is clearly proven.

1. Hadhrat Abdullah bin Mas’ood (Radiallaahu Anhu) narrates that Rasulullah (Sallallaahu Alayhi Wa Sallam) said, "It is not lawful to (spill) the blood of a believer who testifies that there is no Deity but Allah and Rasulullah (Sallallaahu Alayhi Wa Sallam) is the messenger of Allah Ta’ala, except on three occasions :

1.1 A n adulterer/adulteress
1.2 A murderer
1.3 A renegade
(Sahih Muslim – Vol 2. Pg 1006)

2. The incidents of the Sahaabi Ma’iz ibne Malik and the Ghamidya woman are clear cut and found in almost all the books of Hadith. They were both pelted to death after testifying to adultery.

3.Hadhrat Abdullah ibne Abbaas (Radiallahu Anhu) narrates the lecture that Hadhrat Umar (Radiallaahu Anhu) delivered whilst sitting on the pulpit of Rasulullah (Sallallaahu Alayhi Wa Sallam)

Hadhrat Umar (Radiallahu Anhu) said, "Verily, Allah sent Muhammad (Sallallaahu Alayhi Wa Sallam) with the truth, and revealed the Quran upon him. The verse regarding the stoning of the adulterer/ess was from amongst the verse revealed (in the Quraan). We read it, secured it and understood it. Rasulullah (Sallallaahu Alayhi Wa Sallam) stoned and we stoned after him. I fear that with the passage of time a person might say, ‘We do not find mention of stoning in the Book of Allah and thereby go astray by leaving out an obligation revealed by Allah. Verily, the stoning of a adulterer/ress is found in the Quraan and is the truth, if the witnesses are met or there is a pregnancy or confession."

The famous commentator of Muslim Shareef, Imaam Nawawi (Rahmatullaahi Alayhi) mentions regarding this lecture of Hadhrat Umar (Radiallahu Anhu), that this fear that Hadhrat Umar (Radiallaahu Anhu) had, is found in the Khawaarij and those who agreed with them. Therefore this is a miracle of Hadhrat Umar (Radiallaahu Anhu) It is also possible that he (Hd. Umar Radiallaahu Anhu) learnt this from Rasulullah (Sallallaahu Alayhi Wa Sallam).

4. Hadhrat Jabir (Radiallaahu Anhu) narrates that a person from the Aslam tribe came to Rasulullah (Sallallaahu Alayhi Wa Sallam) and admitted that he had committed adultery. He testified four (4) times. He was a married man. Rasulullah (Sallallaahu Alayhi Wa Sallam) ordered that he be stoned.

5. Hadhrat Abu Huraira (Radiallaahu Anhu) says that when Rasulullah (Sallallaahu Alayhi Wa Sallam) gave the order of stoning, he Rasulullah (Sallallaahu Alayhi Wa Sallam), said, "By that Being in whose control is my soul, I will grant an order with the Book of Allah."

After acknowledgement Rasulullah (Sallallaahu Alayhi Wa Sallam) gave the order of stoning.

Sahih Muslim, Vol 2. pg 69

In this Hadith Rasulullah (Sallallaahu Alayhi Wa Sallam) clearly says that "stoning" is in accordance to the Book of Allah.

In light of the above, the Khulafa-e-Rashedeen and the leaders of the Ummah had all practised "stoning".

1. Hadhrat Uthmaan bin Affaan (Radiallaahu Anhu) stoned an adulteress. (Muwatta Malik pg 686, Nur Muhammad, Araam Baagh)

2. Hadhrat Ali (Radiallaahu Anhu) stoned a woman on a Friday and said, "I stoned her in accordance to the teachings of Rasulullah (Sallallaahu Alayhi Wa Sallam) – (Sahih Bukhari Vol 2, pg 1006)

The Consensus of the Ummah

From the time of the Sahabah (Radiallaahu Anhum) to this date all believers are unanimous that a married adulterer/ess should be stoned. This consensus is reported by many of the famous scholars. A few are listed.

1. Hafiz ibne Hazam in Maraatibul Ijmain

2. Ibne Qudaama (Rahmatullaahi Alayhi) in Al Mughni, Vol 10. pg 118

3. Abul Waleed Muhammad bin Ahmed Al-Qurtubi in Bidaayatul Mujtahid Vol 2 pg 325.

Allam Anwar Shah Kashmiri writes in his book Ikfaarul Mulhideen, pg 57,

"Similarly, there is a consensus of the Ulama to disassociate from Islam, all those who argue about that which is found clearly in the Quraan, e.g. The Khawaarij are regarded as disbelievers because of rejecting the stoning of a married adulterer/adulteress.

There is much more that could be said on this subject. However this should suffice to make the Ummah understand the law of stoning. This should be an eye-opener for everyone, especially those who have a tendency to speak excessively, that one should rather remain silent if one is unaware of the Islamic ruling.

Uttering statements contrary to the Quraan and Hadith could lead to Kufr, which in turn drags one to the Hell-fire.

Hadith : Hadhrat Abu Hurairah (Radiallaahu Anhu) reported that Rasulullah (Sallallaahu Alayhi Wa Sallam) said, "A servant utters a word pleasing Allah without considering it important, yet Allah gives him many more ranks thereby, and a servant utters a word displeasing to Allah without considering it important yet he goes to Hell on its account." (Sahih Bukhari.)

May Allah save us all from His Displeasure and Wrath and instill in us the Love for the true teachings of the Qur’aan and Sunnah. Ameen.

Welcome aboard, the sisters need a stronger wahabi aka salafi voice like yours, but first let me make clear to you the point of contention was that wahabis aka Salafi believe that a hadith can abrogate an ayat, and not they alone view stoning adultery. And as a matter of fact, you reposted what proud copied and pasted already.

Let us get this right he Qur'anic verses were promulgated by the Prophet pbuh and that it was he whose authority was necessary for the abrogation of any Quraanic verse; In this contentious issue of adultery, except Uthman, not the Prophet pbuh, no Companion, not even Abu Bakr ra or Ali ra, could say that the aultery verse was abrogated. The Prophet pbuh alone was entitled to say so, and there is not a single tradition to the effect that he ever said so; it is always some Companion or a later authority to whom such views are claimed to be traced. Then, what is the use of the ayat of flogging remaining in the Holy Book of Quraan?

No, J.B it is not the same, in adultery we have a clear Command ayat that mentions the punishment(s)for adultery, and are as follows:

The woman and the man guilty of adultery or fornication,- flog each of them with a hundred stripes: Let not compassion move you in their case, in a matter prescribed by Allah, if ye believe in Allah and the Last Day: and let a party of the Believers witness their punishment.

Let no man guilty of adultery or fornication marry and but a woman similarly guilty, or an Unbeliever: nor let any but such a man or an Unbeliever marry such a woman: to the Believers such a thing is forbidden.

Since the revelation of this ayat, the prophet pbuh have not condemned a Muslim or otherwise to stoning. Why Now? What we gonna do with this ayat now, dump it? Is that what you are suggesting?

"Say (O Muhammad), 'I am no more than a human being like you. It has been revealed to me that your God is ONE GOD. Therefore, you shall observe Him ALONE, and ask His forgiveness."
Qur'an 41:6

Stoning was Canon Law. In the hadith, there were people that were stoned to death but they were Jews. Prophet Mohammad pbuh was the leader at the time and according to Jewish law, the punishment was stoning. Later it was implemented stoning as the punishment of adultery due to the decadency of the societis at that time, although it does not apply to follow the COMMANDS of the Quraan. There are four major Sunni schools, none of which is sanctioned by Allah SWT, or the Prophet pbuh. The early scholars who are so revered today understood that their RULINGS WERE NEVER MEANT FOR ALL PLACES AND ALL TIMES. They never meant for their rulings to be adopted in places they were not meant for, so doing so is an innovation and a failure to follow the very folks you believe you're following. Kind of ironic.

So, in-order for you to follow a school with any consistency, you would have to follow rules formulated within the context of societal norms that are out of sync with the life you live. For example, if your madhab says you can't marry without your father's permission or that he can marry you off without your permission (sorry if you are male), would you go along with that for yourself or your daughters? If the mad-hab says you cannot travel without a related male (again sorry if you are male) with you or without his permission, are you ready to go along with that?

The case of stoning, it's in ahadith and fiqh (opinions of scholars) that we find many of the extra-Quranic laws that don't exist in the Quran or even in the Prophet's pbuh Sunnah, because they have been derived from the context of the societies they were developed in.

Madhabs developed many years after the Prophet's pbuh death, so we have no indication as to what he would have to say about them; they are not Sunnah. There have also been dozens of them, not just four; the ebb and flow primarily a matter of gaining or falling out of favor with the powers that be. This is how Wahabiism became the state religion of the KSA - the rulers chose it and forced it on others. Since all of the mad-habs are correct (in theory), and none of the rulings are divine, but rather, derived by fallible mortals, and nothing they do is sanctioned by Allah SWT, then how can it be problematic to either ignore them completely, or take it piecemeal like you guys do?

Let me conclude that it is not revisionism to uphold the Word Of Allah SWT, and that is why we need Ijtihaad so desperately.

Allah Swt Commands us;

Law26 there is no point debating an issue on which the sahaba and our great scholars are unanimously agreed upon. Stoning a married person for adultery is the set punishment in the Shariah. Who said that the ahadith abrogated any ayah? If you claim that the ayah of rajm (stoning) has been abrogated then please bring your hadith to show this. After all you clearly state that the Prophet (PBUH) is the only authority who can declare abrogation. If you read my early Q&A it states “A person married in a valid Islamic contract would be lashed 100 times and then stoned to death.” So there is clearly no need to abrogated 100 lashes for the adulterer! He is lashed then stoned. We have no need to resort to abrogation here. The Ayah of Rajm has been documented in ahadith. The prophet sentenced muslims to stoning (not only jews), the sahaba implemented stoning after the Prophet’s death (PBUH) and all the great scholars of islam have confirmed the prophets sunnah of stoning. The only way to arrive at your conclusion is to
1) reject the prophets ahadith
2) reject the ruling of the sahaba
3) reject the rulings of all the 4 sunni schools
4) Having a great opinion of your self reasoning.

As for us the prophets sunnah and our beloved sunni scholars are far superior to what you have to offer us.

Listen brother, you can’t just change Islamic Laws and principles that our prophet and his Companions have practiced during their life time. Nobody is free enough to have his/her own choice after Allah swt and His Prophet have decreed a matter. Allah swt said in his Holy Koran “It is not for a believer, man or woman, when Allah and His Messenger have decreed a matter that they should have any option in their decision. And whoever disobeys Allah and His Messenger, he has indeed strayed into a plain error.” Surat 33 verse 36.

This verse has summed up your point and there is nothing to be discussed in here unless you want to dismantle our great prophet’s Sunnah. Moreover, the verse you are claiming about did not abrogate this practice at all. If you consider people who practice the Sunnah as a Wahabi, I think those people are honorable and God fearing Muslim.



Ignoring The Sunnah may lead you stray away from the right path brother. Just be careful.

If you follow fiqh and scholarly opinion, then that is up to you, I will follow the Sunnah and the Quraan, Allah SWT own Words.

When the Prophet had not received a revelation abrogating a prior law, he applied prior revealed law:

Narrated Ibn Umar (RA): A Jew and a Jewess were brought to Allah’s Apostle (S) on a charge of committing illegal sexual intercourse. The Prophet asked them: ‘What is the legal punishment (for this sin) in your Book (Torah)?’ They replied: ‘Our priests have innovated the blackening of faces with charcoal and Tajbiya’ (being mounted on a donkey, with their faces in opposite directions, then mortified in public). Abdullah bin Salaam said: ‘0 Allah’s Apostle, tell them to bring the Torah.’ The Torah was brought, and then one of the Jews put his hand over the Divine Verse of the Rajm (stoning to death) and started reading what preceded and what followed it. On that, Ibn Salaam said to the Jew: ‘Lift up your hand.’ The Divine Verse of the Rajm was under his hand. So Allah’s Apostle (S) ordered that the two (sinners) be stoned to death, and so they were stoned. [Bukhari 8:809].

If a Bukhari hadith is not so sure if the Prophet pbuh mandated the stoning of apostates after the revelations of the ayats, how could we deny the legitimacy of Allah Words that are still in the Quraan that we read today? Take of the layers of Jahliya from your eyes

Narrated Ash-Shaibani: I asked Abdullah bin Abi Aufa: "Did Allah’s Apostle (S) carry out the Rajm (stoning) penalty." He said: "Yes". "Was it before the revelation of Surah An-Noor (24:02) or after it?" He replied: "I don’t know." [Bukhari 8:804]

Wiseman, no one is trying to change Islamic Law, but we are trying to follow its main source which is Allah SWT’s Commands and why can’t you understand Allah’s Word? Allah SWT says in His Holy Book.

The Quran does not prescribe stoning for adultery. These are Allah SWT's Words and not mine:

The Noble Qur'an An-Nur 24:2-9

2. The woman and the man guilty of illegal sexual intercourse, flog each of them with a hundred stripes. Let not pity withhold you in their case, in a punishment prescribed by Allâh, if you believe in Allâh and the Last Day. And let a party of the believers witness their punishment. (This punishment is for unmarried persons guilty of the above crime but if married persons commit it, the punishment is to stone them to death, according to Allâh's Law).

3. The adulterer marries not but an adulteress or a Mushrikah and the adulteress none marries her except an adulterer or a Muskrik [and that means that the man who agrees to marry (have a sexual relation with) a Mushrikah (female polytheist, pagan or idolatress) or a prostitute, then surely he is either an adulterer, or a Mushrik (polytheist, pagan or idolater, etc.) And the woman who agrees to marry (have a sexual relation with) a Mushrik (polytheist, pagan or idolater) or an adulterer, then she is either a prostitute or a Mushrikah (female polytheist, pagan, or idolatress, etc.)]. Such a thing is forbidden to the believers (of Islâmic Monotheism).

4. And those who accuse chaste women, and produce not four witnesses, flog them with eighty stripes, and reject their testimony forever, they indeed are the Fâsiqûn (liars, rebellious, disobedient to Allâh).

5. Except those who repent thereafter and do righteous deeds, (for such) verily, Allâh is Oft-Forgiving, Most Merciful.

6. And for those who accuse their wives, but have no witnesses except themselves, let the testimony of one of them be four testimonies (i.e. testifies four times) by Allâh that he is one of those who speak the truth.

7. And the fifth (testimony) (should be) the invoking of the Curse of Allâh on him if he be of those who tell a lie (against her).

8. But it shall avert the punishment (of stoning to death) from her, if she bears witness four times by Allâh, that he (her husband) is telling a lie.

9. And the fifth (testimony) should be that the Wrath of Allâh be upon her if he (her husband) speaks the truth.

That is why no Muslim would like to live in a mambo jumbo dictatorial half baked Islamic Law Muslim country. No one gives anymore a rat’s ass about Allah SWT words, fiq and consensus of scholars of more than 1000 years is more important, and that is why their interpretations is out of touch with this world. The Holy Quraan is for all times, and once we tamper with, then it becomes unworkable and Muslims will reduced to a cultural Islam that leads to them to the conditions that most Muslims find themselves in Muslim countries.

Follow your hadiths and scholars who abrogate the Quraan, and I don't belong to any school and will Allah SWT and hadiths that don't contradict with His words.

This is not about Wahabi this and Wahabi that.
It is clear that the concensus around the scholars in the 4 great madhabs that stoning is shareeca.

I may not think highly of salafis but when there is ample evidence from the the difference scholars this is all that we need.
They were more capable of fiqh than you or me, infact thier words carry more wieght then any scholar living today.

here is one more example from sahih bukhari

Jabir (Radiyallahu canhu) narrates that a person from the Aslam tribe came to Rasulullah (Sallallahu Alayhi Wa Sallam) and admitted that he had committed adultery. He testified four (4) times. He was a married man. Rasulullah (Sallallahu Alayhi Wa Sallam) ordered that he be stoned. (Sahih Al Bukhari – Vol 2. pg 1006)


Ali (Radiyallahu canhu) stoned a woman on a Friday and said, "I stoned her in accordance to the teachings of Rasulullah (Sallallahu Alayhi Wa Sallam) (Sahih Bukhari Vol. 2 pg. 1006 )

The point is we can all find the ayat in question in the current Quraan that we read, is it there for decoration, or we have to follow it? I don't care with what others did or said, I know millions who think like me and therefore will follow it. Is it hard to grasp?

Aren't the same scholars and schools who divided Muslims into so many compartments/sects? What was the use of it?

Its not hard to follow your reasoning but you are threading on dangerous grounds.

You are talking about ijtihad.
The problem is who can we trust with this, when the discourse is dominated by state sponsered scholars who manufacture fatwas when ordered, or other group who take matter into thier own hands.

There is a lack of legitemate leadership in the muslim world.

Follow your Hadith???? Law, Okay! Go ahead and pray salad without teachings of our holy prophet. See, how simple it is.

Anyway, I don’t like arguing or discussing with something we don’t agree completely. I better rest my case rather than indulging a fruitless discussion. It is just like when Somalis say “i jiid aan ku jiide waa gacmo daalis” I always have one policy. Anytime I argue with someone; I either agree with that person if he is right or he agrees with me if I am right (especially when it is an Islamic issue) or I quit the discussion without calling him a name period.

Most Muslims that I know (Salafi, Shia, different schools of Sunni and etc.) want Ijtihad for the same reasons and more that Law26 mentioned above and in the name of unity. Yes, Moch was right, guys agree to disagree.
