FYI: Suicide Bombings Are XARAM and the Scholars have talked
about it. Therefore, this new phenomenon in Somalia has to STOP. Also I don't agree with roadside bombs, shooting behind houses and all of the stupid Xamar mooryan fighting tactics. Excuse my french.

I don't think anyone is happy about that...Roadside bombs and killing innocent people?
Maybe your aunt, cousin, in- law etc or any human being in this matter...
I for one hate killers....No matter how you sugarcoat, no matter what good name you give a killer is a killer..Don't take life...
What is wrong with people... Don't take life in the name of Government, don't take life in the name of Religion and don't take life in the name of Mooryaan or Mujaahid...Don't kill period...

Question: I was really shocked to hear about the wide debate that occurred during the sessions of the Fiqh Council affiliated to the Organization of the Islamic Conference (OIC) concerning the legality of martyr operations. I heard that there was a wide debate among some member scholars there, and some of them said that martyr operations are an illegal practice done by the Palestinians, and with such operations they give Sharon’s government a chance to shed more blood.
Please correct me, as I am really confused and there is much ado everywhere concerning this issue. I would very much appreciate it if you would mention the decisions taken by the Conference concerning martyr operations and the definition of terrorism they reached. May Allah reward you for your efforts in serving the Muslim Ummah. Ameen

All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.
Dear questioner, thank you very much for having confidence in us, and we implore Allah to guide us all to the best way through which we can serve the Muslim Ummah.
Actually, when it comes to the Palestinian issue, we need to focus on certain important points that we have reiterated in many occasions: injustice breeds contempt and violence; oppression calls for brutal reaction; peace and security should be an aspired goal for all parties to the conflict; Justice represents the rights of all people whatever their race, color and religion.
Issuing a judgment or ruling on a certain case should be done in light of all the facts that surround it. As regard the case at hand, we all see what happens daily in the occupied territories in the sense of atrocities committed daily against the innocent civilians, houses demolished, in addition to all forms of humiliation, which all culminated into a gloomy state of affair, filling the mind with utter despair. These are some of the facts taken into consideration when eminent Muslim scholars describe the resistance operations carried out by the Palestinians as a form of a legitimate Jihad against the usurpers and occupiers. This is not a matter of issuing a license to kill. Rather it echoes voices of people crying for justice.
This is the same principle that serves as a basis for the recent resolution issued by The Islamic Fiqh Council affiliated to the OIC in its fourteenth session, held in Duha (Qatar) 5–13 Dhul-Qi`dah 1423 A.H., 11–16 January 2003 C.E.,
Following is the text of the resolution:
1- Islam dignifies man as a human being, safeguards his rights and protects his honor. Fiqh or Islamic jurisprudence is the first jurisprudence all over the world which really presents local and international legislative codes for human relations both in war and peace times.
2- Terrorism equals illegal aggression, terror, threatening both in material and abstract forms which is practiced by states, groups or individuals against man, his religion, soul, honor, intellect or his property via all means, among which is the spread of corruption on earth.
3- The Islamic Fiqh Council asserts that jihad and martyr operations done to defend the Islamic creed, dignity, freedom and the sovereignty of states is not considered terrorism but a basic form of necessary defense for legitimate rights. Thus the oppressed peoples who are subjected to occupation have the right to seek their freedom via all means possible.
4-The Islamic Fiqh Council stresses that martyr operations are a form of jihad, and carrying out those operations is a legitimate right that has nothing to do with terrorism or suicide. Those operations become obligatory when they become the only way to stop the aggression of the enemy, defeat it, and grievously damage its power.
5-It is not allowed to use terms such as “jihad”, “terrorism”, and “violence”, which have become frequently used by today’s mass media as scientific terms, to mean other connotations beyond their basic well known meanings.
In light of the above, there is no change concerning the Islamic ruling regarding martyr operations as such operations are considered true jihad in the Cause of Allah.

Martyrdom Operations
"The martyrdom operations carried out by the Palestinian factions to resist the Zionist occupation are not in any way included in the framework of prohibited terrorism, even if the victims include some civilians."
"This is for several reasons:"
"First of all, due to the colonialist, occupational, racist, and [plundering] nature of Israeli society, it is, in fact, a military society. Anyone past childhood, man or woman, is drafted into the Israeli army. Every Israeli is a solider in the army, either in practical terms or because he is a reservist soldier who can be summoned at any time for war. This fact needs no proof. Those they call 'civilians' are in effect 'soldiers' in the army of the sons of Zion."
"Second, Israeli society has a unique trait that makes it different from the other human societies, and that is that as far as the people of Palestine are concerned, it is a 'society of invaders' who came from outside the region - from Russia or America, from Europe or from the lands of the Orient - to occupy Palestine and settle in it…"
"Those who are invaded have the right to fight the invaders with all means at their disposal in order to remove [the invaders] from their homes and send them back to the homes from whence they came… This is a Jihad of necessity, as the clerics call it, and not Jihad of choice… Even if an innocent child is killed as a result of this Jihad - it was not intended, but rather due to the necessities of the war… Even with the passage of time, these [Israeli] so-called 'civilians' do not stop being invaders, evil, tyrants, and oppressors…"

Because they fight against and are hostile towards the Muslims, they annulled the protection of his blood and his property."

The entire domestic front, including professionals, laborers, and industrialists, stands behind the fighting army, even if it does not bear arms. Therefore the experts say that the Zionist entity, in truth, is one army."

"What weapon can harm their enemy, can prevent him from sleeping, and can strip him of a sense of security and stability, except for these human bombs - a young man or woman who blows himself or herself up amongst their enemy. This is a weapon the likes of which the enemy cannot obtain, even if the U.S. provides it with billions [of dollars] and the most powerful weapons, because it is a unique weapon that Allah has placed only in the hands of the men of belief. It is a type of divine justice on the face of the earth… it is the weapon of the wretched weak in the face of the powerful tyrant…"
'Those Who Oppose Martyrdom Operations and Claim that they are Suicide are Making a Great Mistake'
"Those who oppose martyrdom operations and claim that they are suicide are making a great mistake. The goals of the one who carries out a martyrdom operation and of the one who commits suicide are completely different. Anyone who analyzes the soul of [these two] will discover the huge difference between them. The [person who commits] suicide kills himself for himself, because he failed in business, love, an examination, or the like. He was too weak to cope with the situation and chose to flee life for death."
"In contrast, the one who carries out a martyrdom operation does not think of himself. He sacrifices himself for the sake of a higher goal, for which all sacrifices become meaningless. He sells himself to Allah in order to buy Paradise in exchange. Allah said: 'Allah has bought from the believers their souls and their properties for they shall inherit Paradise.'"
"While the [person who commits] suicide dies in escape and retreat, the one who carries out a martyrdom operation dies in advance and attack.
