What is Shariah Laws? Walaahi Somalis insulted the concept of Shariah Law.
Now, the latest news is Puntland and Somaliland are adopting Shariah Laws. They will nominate Sheikhs to run courts (7udud, criminal law), while politicians run the state. The deal is, leave politics to us, we will leave criminal law to you.
Don't dare to ask if these Shariah Courts in Puntland and Somaliland will support Al-Shabab? The answer is no, because the so called 6 months of peace in Moghadiscio under the Icu there were more than 7 Islamic Courts run along tribal lines in Mogadiscio. Is this Shariah Laws?

American Suufi,
The bigger question when you do have sharica laws along tribal courts is which court do you judge a criminal ? Is it based on the qabiil of the criminal ? Or the qabiil of the victim ? Or would it be where the crime occurred ?

Brother, strictly only on jurisdiction. They can't have Extradiction Treaty.AbdiWahab252 wrote:American Suufi,

American Suufi,
I was opposed to these courts because they were unfair to those from smaller qabiils or qabiils who did not support them

I'm not sure what your objection is about. It seems perfectly reasonable for me to appoint Shaykhs to the Courts, dealing with the Law. I do know, however, that there is a separation of powers where Law and Governance are concerned. Interpreting and Enforcing the Law is the job of the Judicial System. The idea that Shaykhs also rule is a peculiarity of Khomeini and his Vilayet-i-Faqih idea.American-Suufi wrote:What is Shariah Laws? Walaahi Somalis insulted the concept of Shariah Law.
