The Republic of Somaliland was the separate country under the name "British Somaliland", with clear internationally delineated boundaries until 26 June 1960 when it became the independent From Great Britain on June 26th 1960 and became known as " Somaliland". Of the 18 African countries which became independent in 1960, Somaliland was the fourth country in that year and was welcomed by many countries. It had a Constitution of its own, a government, and an elected legislature and a judiciary. Somalia (former Italian trusteeship) was the seventh African country to become independent that year (with Madagascar and the Democratic Republic of Congo receiving their independence in between).
On Somaliland consitution 1960: The first verses talked about the territories of somaliland "Territory of Somaliland:
(1) The territory of Somaliland shall be all that territory which on the commencement of this Constitution, is comprised in Her Britannic Protectorate of Somaliland."
Somaliland was recognized:
The history archives evidently highlight the existence of Somaliland, and 35 countries recognized Somaliland after independence from Great Britain including the United states and Britain.
The Somaliland Cabinet 1960:
1- Mohamed Ibrahim Egal – prime minister..SNL
2- Garad Ali Garad Jama – Minister USP
3- Ahmed Hajji Duale (Keyse) – Minister
4- Hajji Yusuf Iman – Minister
5- Hajji Ibrahim Nur – Minister
Voluntary Union wanted by the people:
1st July 1960 unity between British Somaliland and Italian Somalia was signed without preconditions. Mohammed Ibrahim Egal and other educated members of Somaliland expressed their willingness to remain independent for at least six months, but the public refused and forced them to hand over the independent to Italian Somalia.
Also, Minister Garad Ali Garad Jama, a dhulbahante elder asked the leaders and chief tribes of Somaliland to remain independent but the crowd roared with famous Somali Proverb "Laa Yaa GARAD" which means NO MR. GARAD even some historians reported that Prime Minister Mohamed Egal was hit by one person with Pepsi Cola bottle on his neck, after Egal asked for delay in unity with Italian Somalia.
Today the honorable people of somaliland who said 'yea' to unity then, say nay to unity now. It's their call and their wish.
The act of union and the voluntary merge was derailed by the dictatorship regime of Siyad barre. Soveignty was lost, now somaliand can get it back that lost statehood based on the principle of 'self determination'. And according to the UN it says the following.
Bringing back the lost nation:
Principle of Self determination:
‘the belief that each
nation has a right to constitute an independent state and determine its own government.’
What is a nation and does somaliland qualify to be an independent nation?
-A ‘nation’ is a group of people who share a significant number (but by means necessarily all) of the
following attributes: history, language, ethnic origin, religion, political belief, fear of the same
adversaries. In short, a nation may be defined as ‘a community that is, or wishes to be, a state.’
(The above quotations are from Alfred Cobban, The Nation State and National Self-
Determination, rev. edn. 1969, pp. 39 and 108.)
The Declaration of Independence of the United States (1776) contained a classic expression of
the principle of self-determination: ‘When in the course of Human Events it becomes necessary for
one people to dissolve the political bonds which have connected them with another...’
On 1 January 1988 there were 159 member states of the United Nations. Today there are 191.
The great majority of the 32 new members (Switzerland is the exception that proves the rule) are
countries that have recently emerged to new sovereign statehood, or regained a statehood that
was lost earlier.
Case for independence:
Some theories of secession emphasize a general right of indepedence for any reason (“Choice Theory") while others emphasize that independence should be considered only to rectify grave injustices: Somaliland seccesion case qualifies as follows:
-The right to liberty, free association and private property.
-Consent as important democratic principle; will of majority to secede should be recognized...will of the majority meaning sool and e. sanaag cannot overule the case for seccesion.
-Making it easier for states to join with others in an experimental union
-Dissolving such union when goals for which it was constituted are not achieved
-Self-determination of peoples .
dissolved unions
Belgium and The Netherlands
Main article: Belgian Revolution
On August 25, 1830. Soon after, the Belgian Revolt occurred, which resulted in the Belgian secession from The Netherlands.
In 1838 Nicaragua seceded from the Federal Republic of Central America, which was formally dissolved in 1840, all but one of the states having seceded amidst general disorder.
Cyprus
In 1974 the Turkish Army conquered northern Cyprus to protect the interests of the ethnic Turkish minority, who in the following year formed the Turkish Federative State of Cyprus and in 1983 declared independence as the Republic of Northern Cyprus, recognized only by Turkey.
East Timor
Timor Leste formerly known as East Timor successfully seceded from Indonesia on May 20, 2002. East Timor had been a Portuguese colony since the 16th Century. In 1975 Portugal passed law 7/75 allowing for a transitional government with elections to be run in 1976. Portuguese sovereignty was to be terminated in October 1978. On August 11, 1975 one of the political parties UDT staged a coup in the capital of Dili. Other political parties responded; essentially civil war broke out and the Portuguese retreated. On November 28, 1975 FRETILIN declared unilateral independence and established the Government of the Democratic of the Republic of East Timor. The other parties dissented, and instead accepted the proposed integration to Indonesia and on July 17, 1976 it was made official by the Indonesian Parliament. After much bloodshed Indonesia allowed the Timorese to vote in 1999 on independence. The "yes" vote was overwhelming and on May 20, 2002 they were officially an independent country.[17]
Ethiopia-Eritrea:
Following the 1993 victory of counterrevolutionary forces in an Ethiopian civil war, Eritrea, which had been united to that country by conquest by Italy, seceded in a United Nations referrendum. Secessionist forces in Tigre and elsewhere agreed to continue Ethiopia as a federation.
Gran Colombia
After decades of tumultuous federalism, Ecuador and Venezuela seceded from Gran Colombia in 1830, leaving the similarly tumultuous United States of Colombia, now the Republic of Colombia which also lost Panama in 1903.
Norway and Sweden
Dissolution of the union between Norway and Sweden in 1905
Norway and Sweden, having left the Kalmar Union in the 16th century, entered into a loose personal union in 1814. Following a constitutional crisis, in 1905 the Norwegian Parliament declared that King Oscar II had failed to fulfill his constitutional duties on 7 June. He was therefore no longer King of Norway and because the union depended on the two countries sharing a king, it was thus dissolved. Sweden agreed to this on 26 October.
Pakistan
After the Awami League won the 1970 national elections, negotiations to form a new government foundered, resulting in the Bangladesh Liberation War by which the eastern wing of Pakistan seceded.
Soviet Union
In 1990, after free elections, Soviet Lithuania declared independence. Others followed and the Soviet Union collapsed.
Spain
Spain (also known as "the Kingdom of Spain") was assembled in the 15th century from various component kingdoms, of which Portugal seceded, by war in 1640.
Sri Lanka
The Liberation Tigers of Tamil Eelam operate a de facto independent state in eastern and northern Sri Lanka which has not been recognized internationally.
-Yugoslavia
On June 25, 1991, Croatia and Slovenia seceded from the Socialist Federal Republic of Yugoslavia. Others followed, the federation collapsed, and the remaining country, now Federal Republic of Yugoslavia, attacked the new-founded countries, starting the Yugoslav Wars.
-Kosovo declared independence on February 17, 2008 and was recognized by several dozeen countries, but remained under United Nations administration for several months prior to succesion. Montenegro peacefully separated from its union with Serbia in 2006
