There's a lot we don't know about this story (National Post, 3/30/09). But what we do know makes it look like another case in which a mother, when her parental rights are threatened, resorts to murder. In the case of Mazoltuv Borukhova in New York, she had her husband murdered to keep him from their daughter. In this case it was the child who died.
Toronto residents Richard and Joy Williams were married and had three children. But Richard made a bad mistake which he admits; he had an affair with Nadine Bernard. She became pregnant and gave birth to his son whom she named Jayden (pictured).
But Joy Williams found out about the little boy and confronted her husband who came clean to her. That's when the unexpected happened. Joy Williams wanted her husband to see his son and bring him into their family. A bitter custody battle ensued between Williams and Bernard, during which he got the court to order visitation four days a week. His and Joy's children took to Jayden as a brother and Joy found him "such a sweet baby" and "so adorable."
At some point, Bernard figured out that Williams was not going to abandon his child and reportedly threatened to move to Florida with Jayden. Williams' attorney advised him to try for full custody of the little boy, a fact Williams conveyed to Bernard. That was the last time he saw Jayden alive.
Bernard has been charged with murder. Neighbors and relatives say she was a wonderful mother, and seem shocked that she would do such a thing to a child.
I'm an outsider looking in. I readily admit I don't know the facts of this case. But we've seen many times before what happens when a mother seems threatened by the possibility or the reality of losing child custody to a father. Kidnapping, murder, false claims of physical and sexual abuse and parental alienation are all part of the repertoire. Judges need to be aware of what can happen.
