**Ignore the dramatic title**
Ina adeer, so I was in my human sexuality class right, and the professor brought up how sex is seen around the world and the view towards pre-martial sex and he mentioned zina right. So he said in a remote nigerian or west african village this women was stoned to death after she was found to be pregnant and not married. So I wanted to ask you, the religion says you need four witness to punish and prove someone is guilty, but if unmarried women is pregnant is that prove enough to carry out the punishment? What is your understanding of this?
Kolombo so gal now!!! how could you do this?

Waan isku naxay, I was like what did you do this time?
I remember this Sheikh was saying the implementation for hadd punishments for sex related crimes should not be rushed. If anything, prosecuting crimes like that should be discouraged, because they are very tricky to prove. Unfortunately, in today's "Shariah" courts, they like to rush prosecuting cases like this because it makes them look like they're busy implementing the Shariah.
Regarding the woman, this was a few years ago in Northern Nigeria. Her name was Amina. The poor woman was almost stoned because of her pregnancy, the court said it was all the prove they needed. As for the man she supposedly sinned with? No sign of him anywhere. She was finally let go, because of international pressure and is in Italy now. Same thing involving a 15 year old girl in Taliban controlled Pakistan (Wazirstan), they whipped a girl for commiting fornication, but where was the guy se did it with? Nowhere. Its things like this that make Shariah courts look bad.
As for the ruling itself, it has to be a witnessed crime and its best if the person repents in privacy. Evidence is 2 hadiths including 1 hadith of a woman who confessed to the Prophet (saw) and insisted on it even after she was turned away. Even with pregnancy, it still must be proven it was conceived through zinah. And when she disputes it and there's no evidence, its best disregarded.

Foxy...a drama less life is meaningless ...give me drama or give me malawax
Diyeesha oh ok..the guy lied then...btw I hate arab people in America they are so apologetic about everything. So the professor asks who is Muslim here and can give some insight on Islamic ruling, this arab guy blabs on about his view of punishment and how he doesn't believe in any form of punishment only make him self look liberal and progressive. It was quite irritating, and I stepped and informed the professor of the actually laws of Islam.
Kolombo, yeah, I was wondering too because it did not make any sense to me. Honestly, I think any sins committed in private should not be the matter of the courts or the government, when acts are done by individuals in public that corrupts the society then they should take action. I heard about the hadith and how the prohphet turned her away and she came back, and he said wait till you give birth, and then wait till your done breast feeding and stuff.

From what I know there are 3 things that are looked when implementing the Shariah:
1-Is the implementation of the ruling out of neccesity? (Hadd daruuri)
e.g. Arresting murderers, rapists, highway robbers, etc. Those who harm the public. This is a top priority.
2-Is the implementation of the ruling something to be used as an example to discourage the public?
e.g. cutting off the limbs of thieves, whipping caasi waalideen, etc.
3-Is the implementation of the ruling to send a moral message to the public?
e.g. stonning adulterers, stoning apostates, etc.
Everything serves a purpose. But when you have ignorant men running the show, you end up with strange things which have little or no basis in the religion. For example, you can't chop off limbs of thieves when there's widespread poverty and hunger. In fact, this ruling was halted during Umar Ibn Khattab's rule because of widespread drought and hunger. These rulings serve the public. But if they involve private matters, its different story than if they involve things which cause public harm.
