The tragedy of the War on Terror was that many innocent people have been captured and held under secret detentions indefinately.

The war on piracy is bearing a similar trend. Somali Fishermen held and tried in Kenya complain that they were captured while in the daily routine of fishing.

No one seems to be questioning how these pirates were captured, from what exact location, and what type of activities were they in.

It's like GUILTY until Proven Innocent.

Grant, you ask a fair question, but your assumptions don't critically question the validity of news reporting standards, most of which quote from the Associated Press.

How does the AP obtain their information? Do they obtain it from Navy commanders or in Kenya since they don't have reporters in Somalia. Are there an independent commission set up to authenticate the sources of evidences used against these pirates.
What you get is a one version of the news, claims and accusations, the content of which are not completely accurate to justify the arrest and trial of these men, who are most likely fishermen.

Pirates are irregulars. How do you distinguish them from real fishermen???

Whenever the Western Navy spot a small boat within the see boundaries of Somalia, there is no doubt such boat is a TARGET and might be chased and detained.
