A debate on way to implement Federalism.

Federalism is the law of the land. It was part of the transition and is now crystalized in the post-transitional Constitution; there is no going back so please do not discuss whether Federalism is appropriate. That debate is done. I want you guys to air concerns and work out ways in which Federalism could be implemented now that there is no escaping it. While writing this response to another topic, I got the idea for you guys to visualize how things should go ideally

To the Darods-

Do you think sometimes Federalism as it is designed now unfairly helps Darod? I personally think a compromise has to be had, for example look at a state like Awdal...would they be forced to be with Hargeisa and Burco under Federalism? Awdal is a best case example of a "one region Federal State."

Federalism is the law of the land, but the conditions they put in place were not a consensus by Somalis but by couple groups in the Roadmap. For example I don't agree with the 2 1/2 states thing. I think a serious compromise has to be worked out by parliament where all Somalis can participate like:

1. If two states or more want to unite, they are allowed to unite.
2. If one state wants to become its own federal state, they are allowed.
3. The Upper House will have the same amount of representatives for every federal state whether big or small (for exp. 2 reps each federal state)
4. The lower House (Parliament) will have formula for more representatives from bigger states that united and lower representatives from smaller states.
5. A sliding scale in terms of resource ownership, federal investment,etc from bigger states to smaller states.

In this formula, there is political freedom for everyone to choose exactly the best course of action for them but while keeping power dynamics fair as well.

Samaroon will be a Federal State, trust me. They are respect by all Somalis. They have powerful Politicians at play, both domestically and internationally. The Samaroon community is amongst the richest, most educated in all of Somalia. Djibouti is build solely on Samaroon support, besides the French. Somali Galbeed has a large size Samaroon community, larger than a lot of other Somali clan's presence, thus the support from Ethiopia and Kilinka Shanaad would be drastic.

Very interesting, I see you have clearly tried to impose the US federal system to the Somali situation: states, congress n the senate. The Roadmap specified the 2 or more regions to copy the existing Puntland and Somaliland models, and perhaps a strong lobbying by Puntland. They never foresaw the problems that could result in such a set up. Places that would have problems with it are: Ximan and Xeeb and Galmudug, the Khaatumo, Awdal, Hiiran and Shabelle Sare, etc. Some however little might resent the idea of including Gedo in Jubbaland. These areas would have to be administered separately from the rest of the country. Or we might end up with messy situation of federal states and single states.

I think it will ultimately come down to the Parliament and the executive branch to sort these thorny issues, they could fail miserably or exceed expectations. there is no middle ground.If they go with the current system it might look like these:

Khaatumo: SSC
Puntland
Somaliland-including Awdal
Gidirland:Mudug, Galgaduud
Midland:Hiiraan, Shabelle Sare, sh. dhexe
Jubbaland
Mirifland: Bay, Bakool, sh. hoose

First of all the voluntary clause of two or more regions merging is just that and not two and a half, only a full region can merge with another full region. The thought that a single state can have a full Federal Member State is not feasible, no single region should be put up to bar with existing Federal Member States consisting of 2, 3 or more regions. That wouldn't be fair.

The concept of Federal Member States is built on the 18 original regions and its not anyone fault that Bari and Nugaal are populated by the same folk, nor is Puntland in the way of Hiraan merging with Galgaduud. People just have to learn to put their egos aside and compromise if they want to have the same platform as Puntland etc. Awdal already has a large number of Isaaq population, no point shunning the Isaaq already living in Awdel in favor of Reer Borame. If and when it comes down to Federal Member State option, Awdal would have no problem joining with Waqooyi Galbeed since both would equal each other out, again is a matter of compromise and not a matter favoritism. Puntland worked hard for what is has and so should everyone else.

Lower Jubba and Middle Jubba already fulfil the Federal clause what's keep Gedo with them? You make two assumptions; 1. That Marehan have nothing to do with the Jubooyin and 2. Including Gedo with 2 Jubba is a Marehan idea...remember Azania? No one disliked that org than Marehan but Azania of Ghandi was from Dollow to Kismaayo. I think there is a natural reality a federal state there would go from Dollow on the Ethiopian border to the Indian Ocean, "Darod" land.

The rest of what you wrote, some made sense, some didnt but you are right the American system I find very appropriate in this situation?

Puntland had an outsize role in the Roadmap, as a result building the base of the current system but the current system is not written on gold. The idea behind having a "Parliament" is to entirely have the laws and control over the country by the people. I think the issue of how to form federal states WILL be revisited and we have to be prepared to compromise. This is the compromise I put forward.

Puntland will value and cooperate with the Somali Federal Government according to the Federal Government’s fulfillment of previously reached agreements and adherence to constitutional provisions, including:

.Adherence to the Provisional Federal Constitution of Somalia;
.Implementation and completion of the federal system of government in Somalia; .Support for the ongoing formation of the remaining Federated States, such as ‘Jubaland State’, a new state in the Digil and Mirifle community lands, and other Federated States of Somalia; and
.Equitable distribution of international assistance granted in the name of the Federal Republic of Somalia.

Finally, Puntland Government will closely observe how the Federal Government’s various institutions exercise powers specified in the Provisional Federal Constitution of Somalia.

We've wasted a good decade ending the transition, enough is enough. But if this government wants to waste another decade I think it has that choice, it won't be pretty.
