Military judge removed from Fort Hood shooter case

A military appeals court has removed the judge who had been overseeing accused Fort Hood shooter Maj. Nidal Hasan’s court-martial, saying the judge was biased.

The ruling makes Col. Gregory Gross’ order for Hasan’s beard to be shaved invalid. Hasan has objected to the order with various appeals, citing religious freedom.

“We order the removal of the military judge on the basis of the appearance of bias,” the court document states.

The U.S. Court of Appeals for the Armed Forces faulted Gross with allowing the proceedings to become a “duel of wills” between him and Hasan rather than focusing on the serious crimes with which Hasan is charged.

Hasan, an Army psychiatrist, has been charged with 13 counts of murder in connection with the November 2009 shooting spree at Fort Hood, the sprawling Army post in central Texas.

The court, however, did not rule on the beard issue directly and left open the possibility that a future judge may order Hasan shaved again.

“Should the next military judge find it necessary to address Appellant's beard, such issues should be addressed and litigated anew,” the document states.

Army regulations prevent most soldiers from wearing facial hair while in uniform. Hasan, a practicing Muslim, maintains that he has the right to wear the beard under federal law protecting religious rights.

The high-level appeals court is an independent tribunal with worldwide jurisdiction over active-duty members of the U.S. armed forces and others subject to the Uniform Code of Military Justice.

thug, the law prevails in America :up: look @ this man, he killed over a dozen service men/women and the judge who asked him to trim his beard has been removed from the trial :up:

I was almost arrested in the UAE for mistaking one of the ruling family member for airport workers :)

lol waryaa, definately, they are more fair and transparent than us. that's why im so sciptical to practice law here. cause i know many people here are above the law and you can do nothing about it.

Bro Hyper, I thought it was not an isolated incident and you cast out all the doubt :) That guy I mentioned above was sitting at an "information" counter and I asked him directions. He ignored me a couple of times and I finally said do you understand English? Still no word from him, a uniformed Indian man came rushing from a nearby restroom and talked to him in Arabic, almost bowing down. After a few exchanges the Arab left and the Indian told me I was lucky he didn't arrest me yelling @ him .. He said he is prince so and so....

waryaa that is just normal in the area. there was somali guy who was a driver for one of the royal family member in our area. the guy isnt exactly a driver for the prince but his family driver. one day he payer in near by mosque with me and told me , he was not paid for 4 months!!! i am like did you ask him why not paid? he said never seen him and imscared to speak with the wife. he was accually asking me legal way to ask his salary. i told him, for sure you cannot hire a lawyer cause no lawyer would take your case and you cannot take it to police. i asked him do you have hiring decument, so i could read the agreement. he say , no he didnt sign anything.

i wish if i see him again and ask him if he paid since. that was ramadan. wallah wan ka nahay.

Hyper it is like that in Somalia. Today they beat up an innocent motorist in the middle of the street :( u can see that in the extreme section :)

Hows the security situation in Somalia? Are the police corrupt or fair? Is their much in terms of legality, like if you and I get into a dispute are there courts set up that would take the case and make a ruling on it? Thanks

The longer I lived in the US, The deeper my admiration grew for most aspects of it. Best part is how anyone can take advantage of the opportunities in the system if they have a fresh start with no history behind them. From no one to someone, from wanderer to a citizen, from penniless to middle class, from no degree to double major, only in America can you thrive if you put your mind to it.


PS: Wouldn't sing Union's tune though. No country is perfect including the United States of America.

I don't always agree with what the gov in America does , but I wouldn't wanna live anywhere else .
Wallahi I even had more money when I was in Africa , laakiin I like America because if you think you've been done wrong , you will always find somebody to fight with/for you .

waryaa, human are like that when there is no accountability. every one steps on lower than they are. and it's like that in all classes. qof walba qof ka ka hooseyo mistreat them. it's like a culture. i can mistreat my maid, beat him, harass her , not pay for her , hadan Allah ka baqeynin. cause i know the authority will let it slide for me! and so e one hire than i am if they do to me same. and so on. norespect for human and laws are not applied equaly.

i wish the same. i even would trade my citizen to an american with no regret wallah. the respect of law what im interest of it. not political. i just want meel simply i can pra tice my religion teach and be a good citizen and in peace.
