Yes he was. He didn't critique Islam, he was allowed to do that many times but he kept objectifying the Prophet.

His atheist view wasn't the reason he was banned. His blasphemy against the prophet was. Two different things

In a free democratic society which I'm assuming your bravado originates from, you can't attack other views within that society. That is what he did.
