Re: Ask Islamic question thread.
If you truly want an honest answer... Please ask a sheikh that you find knowledgeable because here you will have trolls saying whatever they wants and saying its halal.
Re: Ask Islamic question thread.
Of course I am not going to take trolls opinion. The person has to back it up with either the Qur'an ,Hadith or Fatwa from well known SheikhsSelfD wrote:If you truly want an honest answer... first, zawaj mut'ah and what somalis call khurb sir not same.
mut'ah means; to enjoy each other with conditions to end the marriage time they both agree ( a month, year, a week , a days etc) with ajer(to give money , both parties agree). this kind of marriage shia and sunna disagree.
However sunnah, devoloped another one that they call " misyaar" means woman gives away her rights for providing, housing and get halal sex from time to time. each use different ahadeeths that contraduc each other.
khutbah sir as somalis know, is secrate marriage hence the word (sir).
traditional marriage; 2 witness, mher, and wali(this disagreed according age of the woman etc) . that is valid marriage and basic requirememts.
in the end men who benifit. if you agree for your motrher, sister, daughter...then go ahead and do it.
i am a judge and marry people, i dont care what they agreed behind my back, i just marry them under condition, law allows me. if they get me 2 witness, most times , we can get random 2 males, name the mehr and walli or who acts as a wali. i get them marriage certificate.

Thank you for the clarification. So as long you have two witness , meher and wali you are good to go. So you can disregard the wali if she's older than how much?

Re: Ask Islamic question thread.
well, the mathahib disagreed slightlly, if woman is mature, or divorces etc.
marriage in islam is just like contract , just like contract/agreement. so yes, 2 winess and naming mehr, that both agreed and wali. these days is not valid if you do not provide official papers. so you have to register.
some say; divorced or widow doesnt need. only bikir(assuming she is very young) . but aayah is crear: " فانكحوهن بإذن أهلهن " [ النساء : 52 ] says; marry them with permission of their family.
edit, al7anafia, go, if women is adult and mature , no one is her walli and she marry whether she is biki or not.

Re: Ask Islamic question thread.
I know nothing about Islamic jurisprudence. But, I know one or two things about Somali culture. Let me explain to you the notion of qodod-siro. Literally, the word qodob-siro is derived from “ qodob” (point) and siro (secret). It is a marriage that is kept under the radar to ensure that there are no family breakdowns/ conflicts. Usually, the qodobsiro marriage is undergone by a married man and a divorcee or a widow (rarely does qodobsiro involve a gashaanti). Short-term sexual encounters are not the main objective with this kind of marriages of conveniences. Another reason is when social taboos are involved (e.g. when the husband and wife are not somalis or when there is an age gap, caste based discrimination etc). The meher is performed in the same way as other marriages. Usually, the only people who do not know about the marriage are the first wife or wives and their immediate relatives. Gossips, suspicions etc usually mark this kind of nuptials. So sooner or later it is front news. )n recent years, there is another kind of marriage which erroneously is referred to as qodob-siro; polygamous marriageswhere one spouse (husband) marries another woman in, for instance, another country. In this case, the qodobsiro is nothing more than marrying a second wife. The qodobsiro in this case is shorthand for polygamy.
