An HIV positive woman who claims she was sacked by a catering firm because of her status.

The woman on Tuesday told Justice Jacton Boma Ojwang’ that the doctor who treated her at Metropolitan Health Services Ltd decided to take her blood sample for the test.

"It is not true Home Park ordered that my blood sample be taken. It is the doctor who decided to do so," she said.

During a cross examination by defence lawyer, Kamau Karori, the widow claimed the company infringed on her rights to privacy by informing her colleagues of her status.

The defendant said soon after her sacking, she went to look for the medical report after Home Park dismissed her on health grounds.

She has sued Home Park, Dr Primus Ochieng and Metropolitan for compensation. She claims her dismissal was unlawful and a violation of her fundamental rights because the test was done without her consent.

The doctor, she argues, violated her rights by not counselling her and not disclosing the test results. She says the doctor did not ask her to take her husband along for tests neither did he ask about his condition.

During her evidence in chief, she told the court she came to know she was HIV positive after being sacked on April 30, 2002.

Well, we could take precautions and simply kill everyone who tests positive for the virus. And while we're at it, better kill everyone with Hepatitis B and C. Very dangerous. And even though you're not suppose to be able to get cancer from someone else, better not take any chances.......
