According to Geneva Convention, ICJ case continues on as usual in that scenerio. They will give a judgement with or without Kenya's participation ---going back to the time jurisdiction was established in 2015

Kenya will be in breach of the international order which has huge ramifications (from how IMF/ World bank do husiness to how international bodies do work to even how countries give you loans or aid).

Only the Emporers can fiddle with this, even then in a wink wink sort of way.

No judge takes kindly to anyone testing their authority. Covid 19 is unprecedented excuse, but I predict;

1. Kenya will be denied the request bluntly with a "lawyer's denial" ( so airtight and legally aharp that Kenya will be embarrassed, essentially "you have been f-king up for a long time so I'ma get ghetto on you for a min to let you know WASSUP"

2. Or to avoid this, Somalia will be faced with such extenuating pressure that they welcome Kenya's deferral request which causes the Court to say well, in that case so be it.

Obviously it tells me Kenya is so desperate that they want to try #2.
