For the Thegoodshepherd regarding constitutionality of Federal States' structure.

Response to Thegoodshepherd;

  • The Roadmap [out of the transition] Signatories established Provisional Constitution issues be worked out in what eventually became Garowe Principles
  • Garowe I ( Dec, 2011) established language on federalism, including 2 or more states as well as a National Constituent Assembly that would finalize and "adopt" Provisional Constitution replacing "national referendum" for the Provisional
  • Garowe II (Feb, 2012) established the NCA to be 825 delegates based on 4.5 overseen by Technical Selection Committee
  • NCA adopted the Provisional Constitution on 1st Aug, 2012.
  • Shortly that summer the post-transitional FGS Parliament came into existence established by the Provisional Constitution (legitimacy is obsolete in the inverse, the prov const preceded them)
  • Article 49, clause 4-5 of Provisional Constitution directly outlines 2 more states as they were before 1991 as basis for a Fed State

---How they would form or synergize is left up to political arrangement and statutory law (being granted certain number of senate seats as recognition) different to the 2 or more languages controlling what they are composed of which is constitutional law being stated in the Provisional Constitution

So my brother there is a 2 state requirement stated in an adopted binding Provisional Constitution in effect that is currently the most Supreme Law in the land and there are in fact recognized Federal States who have been statutorily awarded senate seats as recognition (why for example Gedo is not awarded senate seats but Hirshabelle is even though Gedo is almost 2X bigger than Hirshabelle and even bigger than current Galmudug and even Southwest States)

And finally, SSC has already been processed because her case is commensurate with Galmudug, the only existing Federal State in breach of the Provisional Constitution regarding what validates a federal state that can be recognized

Galmudug was approved because of "political cooperation" that was based on goodwill. In turn, SSC has been processed because of mutual beneficial return of goodwill. This is how mutually beneficial relationships self-police.

SSC is a done issue. It is a processed case because the laws, customs, and even political settlements underpinning what is the Federal form have implicated SSC's recognition.

Xaartumo Esteedh will never get recognised because it will disappear like Ximan & Xeeb and ASWJ vanished once the Republic of Somaliland gets its act together biithnillah

Galmudug is a proper FMS, all of Mudug belongs to Galmudug so apples and oranges

If in any case the federal government recognises kastuumo as a federal member state. It's the greatest setback for the federalism process , and trust me, Every Somali Clan will have the rights to govern their own Clan territory no matter how big or small their territory is . This may be good or bad for somalia. But I am 100% sure many clans will follow dhulbahante. So those who are defending dhulbahante case today. Should not complain when other clans take over their territory and create their own maamul.

When the xawaadle president Mujaahid jayte arrives in Mogadishu. The donkeys and cagdheer should line up for him. What's the difference between xawaadle and dhulbahante. Bal munaafaqada xamar taala eega.

Even our own jamaame territory will have it's own maamul. Maamulka udubland. Let's see if the dooro MPs can beat our MPs. Dir must have their own administrations.

It really burnt the iidoor to their souls to see the Dhulbahante welcomed like conquering Kings to Mogadishu.

We've come a long way from iidoor shelling and occupation......to the brink of Fedral Member State status.

The first two are not seriously merited legal issues and the 3rs, No big break, Gedo is the most interesting region of Somalia on this issue precisely for this reason---->if Marehan desired a Gedo State as an FMS, the entire southern Somali political system would immediately at the highest organs even birth a new legal precedent to declare a Gedo FMS (delinking it from Kismaayo), but Marehan is the one who desires it not. Marehan may have political differences with Ahmed Madoobe, but not with the concept of Jubbaland. Gedo State has never been implicated and will never be implicated because Marehan sees Gedo and Kismaayo as one single package. And so do Darod interestingly enough.

They may give you some needles and bandages. But don't expect to be recognised as a federal state. The moment they give you that status. Every tom and diick in koonfur will desire the same. Use your common sense. How many clans has 2 or more Districs . Somalia is a very fragile country with tribalism problem.

And we are ready to fuel the Flames and sponsor multiple clans who wants to be free from the dominant clans. No body can get away to cut our country into pieces and keep his one intact. You are nothing but a disputed territory between us and puntland. Somalia should not put itself into this mess. It's already dealing with terrorists at a time Atmis is leaving.

Our case is unique in all of Somalia.
We come from the North of Somalia. A region that is claimed by a secessionist tribe.

By recognising Khaatumo the SFG will in one swoop, cut the legs from under the secessionist, and safeguard Somali territorial integrity.

Khaatumo State of Somalia is in the interests of the Sonali state itself.

No other clan.or region can claim to be from Northern Somalia. So no precedent will be set by recognising Khaatumo.

I don't think you understand disputed territory. Because Somalia has 5 star flag and states "Somali Region" is her territory of "Somali Galbeed" does not mean Somali Region is "disputed territory."

You instituted dispute over SSC, but you have been militarily defeated which is even more conclusive than political settlement.

And nor does Puntland espouse a dispute over SSC.

Las Anod is like Hargeisa, a part of Somalia administered by its own local authority having prevailed in fighting to own that authority. Except SSC does not dispute its membership in Somalia.

Ironically that means Hargeisa is legally disputed territory. But certainly Las Anod is am entirely independent autonomous administration that even won its right to be so through war

Bal mucjisadaan ilaahay amarkiis eega. I have never come across such stunning sense of entitlement to someone else's destiny.

Dhulbahante is not your "sister wife."

Maxaa kaa galay waxuu noloshiisa u goosto? Yaa adiga taada kula leh.

And I will answe that question for you as a Non-Dhulbahante.

Dhulbahante disagreed with the vision others had for his home.

SO HE FOUGHT. HE BLED. HE DIED. HE SACRIFICED.

He doesn't need to worry about any other clan's "feelings" about issues that have nothing to do with HIM.

That's THEIR business

He took care of HIS.

It's a simple and logic question , the federal government can't take responsibilities of multiple small fiefdoms. They prefer larger states that can run their own affairs. So dhulbahante should convince the government why they can't stay with puntland .
.
Majeerteen ma rabo wax lala shir yimaado maaha, somalida oo dhabaan is wada Rabin. This will have a domino effects on all existing States to collapse all at the same time. Nothing is more dangerous than an inspired laangaab Clans.
