can a raped woman be wed like virgin or not raped woman? (according to the Sharia)

what does the Sharia says about rape?

if a woman is raped does she needs to provide four witnesses?

what if the accuser and the accused can't provide witness?

and last, this is just personal; as a man, if a girl you were suppose to wed is raped before the actual marriage to you took place would you still marry her?

I'll let the knowledgeable brothers/sisters (where's SoMaLiSiZz) answer the questions pertaining to Sharia, but I'll answer the personal question:

Yes, I would still marry her. And why not? She has been victimized; would I add insult to her wounds by not marrying her? Such a girl would need consolation, undestanding, care, protection, encouragement, etc.

First, In Shariah Law a woman does not have to bring four witnesses in Rape cases. The burden of proof is on those who dispute her allegations of rape.

Shariah says rape is a crime, no witneses needed the woman's claim has all primacy, and it is between her and God if she lies. Punishment is the same as Ziina punishment, ie unmarried 100 lashes, married stoning to death or whatever they are using these days.


but rape is one of those subjects where cultural taboos take more primacy than actual religious or secular laws. In muslim and in the secular societies woman have suffered societal and cultural scorning for being the victim of rape, and the fault seems to always lie with her.



Arabian Man,

Is it not arab custom to have the bride deflowered by a female relative days prior to her consumation of the marriage? is that not a form of fornication/rape anyway?

I will answer it as an expert in realities on the ground (According of Mahakem shar'eyah).

In Share'a there is 2 kind of marriage for women :

1. Theeb= she was married before , divorced or wodow.

2. Beker= never married before.

Even in Marriage certificate in Muslim countrious there are only those boxes to choose from. If the women was not chaste whatever the reason Zania or raped..that should be between two people whom are marrying and shouldn't share with others (e.g. the judge or the shiekh)

Rape is a crime. The punishment is : first they took Allah's qesas which is lashes for none married or none-mohsen and stonning for mohsen or married. The second punishment is : they have to take her rights from him, so depends from country to another..where I live is 6 years prison and we never take him as a witness for rest of his life.

She doesn't needs to provide any evidences but she should tell close people so that wont be "shobohah" letar on in her life.

The judge or justice system should take seriouslly those kind of accusation.. because if a woman accuses a man for that crime that would ruin his reputation for rest of his life. You can't accuse some one without proof. Otherwise he or she can sue you for "qathf" which is another crime and would be a prison and no one will take you as a witness for rest of your life.

This above statement from somalilight is true as i have read it on an islamic site depicting the same thing.


Btw if she was raped then she still is a virgin as she didn't give her consent!

furthermore i think these are one of the topics that are not discussed probably and taught to everyone!
