II Joint Communiqué

Muqdisho, May 05, 2007 (HawiyeNews.com) — Asmara , Eritrea 4 th of May, 2007

Following intensive three days meeting starting May 1 st to 3 rd May, 2007 in Asmara , Eritrea that focused Way Forward on the Current Situation of Somalia between free Members of Transitional Federal Institutions (T.F.I.) and the Council of Islamic Courts of Somalia (CICS) have concluded the following:

1. Initiating & welcoming the Ethiopian invasion of Somalia and bypassing Transitional Federal Institutions and Violating Transitional Federal Charter and all the Existing Laws of the land since Independence July 1, 1960 The “Legal” Status of this so Called Government is no existence: In addition According to the Charter, the government must cease to exist if it fails to submit within two & half years of the adoption of the Charter the final draft of the permanent Constitution of Somalia as well as a credible report on the completion of the national reconciliation process. The term stipulated in the Charter has expired and Govt's failure to deliver is self-evident Thus the current Govt has no legitimacy as 0f February 22, 2007.

1. We condemn the Violation of International Law of Humanitarian Rights, and committing war crimes against civilians (Genocide, Rapping, systematic destruction of Private and Public Property, Blocking repatriation and Humanitarian Aid Delivery by International Aide Agencies To 320,000 refugees and IDP's) in violation of UN Conventions & Covenants on the Protection of civilians during Armed Conflict.

1. We Appeal the United Nations not to repeat the Past Mistakes of Peace Enforcements Failed Missions on Somalia in 1993. We asks to respect All past and present UN resolutions on Somalia starting from 1992 to present among them resolutions (733, 755, 1725…etc.)

and demand Immediate withdrawal of Somali Territory the Invading Ethiopian Regime Forces in Somalia.

In addition; UN to condemn Results of the Ethiopian invasion: Violation of international law, territorial integrity of Somalia as well as sovereignty; committing of war crimes (Genocide) against civilians in violation of UN Conventions & Covenants on the Protection of civilians during Armed Conflict. International Community must demand prosecution by the International Court of Justice ICJ the Ethiopian & and so called Somali Govt perpetrators of war crimes and crimes against humanity; establish a special International Tribunal in the search for the crimes committed against the Somali people and prosecute the criminals responsible for these hideous crimes.

Finally, we demand an end to Micro Management of the Internal Somali affairs by the Ethiopian TPLF Regime.

1. We declare for the Somali People and International Community our commitment to way forward in resolving and reconstituting the Somalia Unity and Independence through All inclusive Reconciliation based on Justice and Dialogue working with all Stakeholders in neutral Place with end in mind National Unity Government of people by the people for the people.
2. We appeal the Government of United States of America to stop all actions that will hurt the Unity, Stability, Human Rights of Somali People including the Support Ethiopian TPLF Regime's Illegal Invasion, Micro-Management of Internal affairs of the Somalis Before during and after the IGAD Peace Process 2002-2005 and acts of Encouraging the Notorious Warlords that Violated the Cession of Hostility Agreements on Somalia of October 27, 2002 (that has have been passed resolutions against their acts of Violence in Somalia by IGAD Foreign Ministers June 2006, and L.A.S., A.U.) Co-Signed by International Community Members states (IPF), L.A.S., Government of USA, IGAD Member States , and Somalis on behalf of their communities as Heads of Delegations during IGAD Peace process in Eldoret , Kenya that is binding.
3. We express our sincere gratitude and solidarity to H.E. Isaias Afwerki, President of the State of Eritrea and the Brotherly Eritrean people for their Courageous role they are playing in freezing their membership to IGAD Visa Via Violations done to the Somali Nation's Unity Territorial Integrity and Genocide committed its people by TPLF Regime and other ( IGAD Member States ).
4. We commend the honest and genuine approach taken by Organization of Islamic Conference O.I.C., Parliament of League of Arab States, Mozambique Government, and South Africa Government towards their view in the Somali issue.
5. We Appeal the League of Arab States to follow suit the resolutions past by Parliament of L.A.S. last week and deliver urgent relief supplies to displaced Somalis everywhere in particular food and medical treatments. In addition, Political and Moral support to Somali People.
6. We call upon all citizens of Somalia everywhere to forgive and forget their past difference caused by 17 years of Civil Strife and to systematically oppose the Ethiopian Illegal occupation inside Somalia , and defend their country and guarantee the freedom of Liberty , Justice, Unity, Territorial Integrity, and independence of Somali Nation.
7. We Commend and Support fully in Somalia the concerned Local and International Agencies (UN, L.A.S….Etc., and Somalis in the Diaspora efforts) and humanitarian organizations that delivering under threatening by so called Government and difficult situation the urgently needed relief supplies to displaced Somalis everywhere and Periphery of Mogadishu city in particular food, cover and medical treatments and we appeal to do more to safe lives of Children, women, youth and elderly!
